dc.description.abstractThis paper examines the utilisation of biometric data from the Department of Home Affairs National Identification System (‘HANIS’) by South African banks, focusing on balancing data privacy, security, and regulatory compliance. While HANIS has significantly improved identity verification and fraud prevention, its scope is deliberately limited to South African citizens and permanent residents, excluding non-citizens. This exclusivity poses challenges to broader financial inclusivity, particularly for undocumented populations, and reflects the complexities of expanding such systems. Additionally, HANIS faces substantial risks from outdated infrastructure and centralised data storage, which increase vulnerability to breaches. Drawing comparisons with advanced systems like Onfido, a UK-based identity verification platform, this study explores opportunities for modernisation through decentralised models, artificial intelligence (‘AI’), and blockchain technology, while emphasising the importance of safeguards to address errors in automated systems. In contrast, case studies on breaches in India’s Aadhaar and Nigeria’s Bank Verification Number (‘BVN’) systems highlight vulnerabilities common to centralised databases, emphasising the critical need for robust encryption, multi-factor authentication (‘MFA’), and accessible error resolution mechanisms to protect user rights. Recommendations include adopting regulatory sandboxes to promote innovation, implementing advanced security measures, and improving inclusivity for underserved communities already within HANIS’s scope. By addressing these challenges, South Africa can develop a secure, modernised framework that strengthens identity verification, fosters public trust, and enhances financial inclusion while safeguarding sensitive data.
