Abstract
The rapid pace of digitalisation across the globe has ushered in an era of unprecedented innovation and creativity, resulting in certain intellectual property trends emerging. This presents both challenges and opportunities in harnessing intellectual property for the creation of intellectual capital, and has significant implications for business strategies. Based on desk research – mainly an in-depth literature review of online secondary data (grey and white) literature – this chapter provides an analysis of the intellectual property that is emerging and its role in the creation of intellectual capital in the context of digital transformation. It underscores the need for suitable governance structures that provide for effective but balanced protection of emerging digital assets. The chapter discusses legal and policy considerations as well as strategies, including collaborative digital initiatives to navigate the complexities of intellectual property in digital transformation. It also explores the dynamic intellectual property landscape in the digital economy, and its role in socio-economic development. The research is based on the assumption that digital transformation facilitates emerging intellectual property and intellectual property assets, and that existing legal and governance structures must be updated to accommodate these changes.
