<description>Indirect horizontal application of the right to have access to health care services
Pieterse, Marius
Apart from their direct application against the state, the justiciability of socio-economic rights also requires the transformation of those aspects of private law that regulate relationships which are crucial for their effective enjoyment. <description>SLAPP suits: an emerging obstacle to public interest environmental litigation in South Africa
Murombo, Tumai; Valentine, Heinrich
One of the strategies to protect the environment is through public interest environmental litigation supported by democratic participation in environmental decision making. However, there are emerging threats to such litigation including strategic litigation against public participation (SLAPP suits). Courts should use existing procedural and substantive legal tools to protect litigants faced with SLAPP suits.
